Sponsor’s Release and Indemnity Agreement

THIS AGREEMENT is made by and between you, hereinafter referred to as “Sponsor”, and the Presbytery of South Dakota, Synod of Lakes and Prairies, Presbyterian Church (U.S.A.), hereinafter referred to as “Owner”.
WITNESSETHWHEREAS, Owner is the owner of thcertain property known as Camp Rimrock (the “Camp”) located in Rapid City, South Dakota; and

WHEREAS, Sponsor desires to secure the use and possession of the Camp; and

WHEREAS, Owner is willing to allow Sponsor to occupy and use the Camp upon Sponsor’s execution of theis Release and indemnity Agreement; NOW, THEREFORE, in consideration of the above recitals and the mutual promises and covenants contained herein, Sponsor and Owner agree as follows:

1. Release. Sponsor, for itself and its directors, officers, agents, employees, representatives, members, successors, and assigns, hereby releases and forever discharges Owner and its successors and assigns, as well as Owner’s trustees, officers, agents, employees, officials, and representatives from any and all liability, whether joint or several, for any and all claims, actions, demands, damages, costs, expenses, or liabilities which now exist or may hereafter accrue, including all claims, actions, demands, and liabilities whatsoever based on matters now unknown as well as known, unanticipated as well as anticipated, in any manner whatsoever, directly or indirectly, resulting or to result from Sponsor’s occupancy, use or possession of the Camp, or Sponsor’s conduct or activities at the Camp, including, without limitation, any claims whatsoever for damages of any kind whatsoever, for personal injuries of any sort whatsoever, for any propery damage whatsoever, and for any costs or expenses whatsoever. There are hereby discharged and released not only Owner, but also, in like manner, and to the same extent, all other persons or corporations whatsoever such as are classified as joint tortfeasors under DSCL 15-8-11 to 22, and any acts amendatory thereto, completely barring any right of action against any such joint tortfeasors, whether or not named herein, vesting in the person or persons, corporation or corporations, specifically named herein as released and discharged, all rights whatsoever under such statute as to contribution from any such joint tortfeasors not specifically named herein.
2. Indemnity. Sponsor hereby agrees to indemnify and hold Owner harmless from any and all claims, causes of action, losses, expenses, demands or liabilities, including reasonable attorney’s fees, incurred or suffered by Owner and arising from or in connection with Sponsor’s occupancy, use, or possession of the Camp.
